By accessing our Website, exploring our services, or commissioning a custom-tailored garment, you agree to be bound by these Terms, as well as our Privacy Policy, Returns & and Refund Policy, and Shipping Policy, all of which are incorporated by reference herein. These Terms are designed to ensure clarity, transparency, and protection for both parties, particularly regarding the unique nature of our custom-tailored services, which rely on the precise measurements and body shape information you provide.
 

Please read these Terms carefully before placing an order for any of our made-to-order pieces. If you do not agree with any part of these Terms, you must not use our Website or services.

2. Definitions

• Client / You: The individual or entity purchasing or commissioning services/products from Vera Voile.

• Vera Voile / We / Us / Our: Refers to Vera Voile, the legal entity operating this website and providing the services.

• Custom Tailored Garment: Any dress, gown, or other clothing item specifically designed, cut, and sewn to the Client's unique measurements and body shape information.

• Services: The provision of custom tailoring, design consultation, and the sale of garments through the Website.

• Content: All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Content, contained on the Website.

3. Ordering Process

3.1. Placing an Order: Orders for custom-tailored garments are placed exclusively through our Website. You must follow the instructions provided on the Website to select your desired design, provide necessary details (including fabric choice, colour, and any specific customisation requests), and complete the measurement submission process.
 

3.2. Measurement & Body Shape Information Submission: To ensure the perfect custom fit, you are required to submit accurate body measurements and a full-body photograph (from the neck down, as per our guidelines) as part of your order.
 

* Accuracy is Paramount: You are solely responsible for the accuracy of all measurements and the clarity of the body shape photograph provided. Please refer to our detailed "How to Measure" guide and photo submission instructions on the Website. We highly recommend seeking professional assistance for measurements if you are unsure.
 

* Impact on Fit: As our garments are made-to-order based on this information, any inaccuracies in the data you provide will directly impact the fit of the final garment. Vera Voile cannot be held responsible for fit issues arising from incorrect or imprecise information provided by the Client.

 

3.3. Order Confirmation: After placing an order, you will receive an email confirmation from us acknowledging receipt of your order. This email constitutes acceptance of your order and forms a binding contract between you and Vera Voile for the purchase of the Custom Tailored Garment, subject to these Terms.
 

3.4. Right to Refuse Order: We reserve the right to refuse any order placed by you, or any suspicious order, in breach of these Terms, or if there are insufficient details.
 

4. Pricing & Payment

4.1. Pricing: All prices displayed on our Website are in Great British Pounds (£GBP) and are not inclusive of UK VAT. Prices for our Custom Tailored Garments are subject to change without prior notice, but changes will not affect orders for which you have already received an Order Confirmation.
 

4.2. Payment: Full payment for your order, including any applicable shipping charges, must be made at the time of placing your order through the secure payment gateway on our Website. We accept various payment methods as indicated on the Website. Your custom-tailored garment will not be put into production until full payment has been successfully processed.
 

4.3. International Duties & Taxes: For orders shipped outside the UK, prices do not include any local import duties, customs fees, or taxes applicable in your destination country. You are solely responsible for the payment of any such duties, taxes, or fees upon arrival of your garment. Vera Voile has no control over these charges and cannot predict their amount. We advise you to contact your local customs office for further information before placing an international order.

5. Custom Tailoring & Manufacturing Process

5.1. Made-to-Order: All Vera Voile garments are custom-tailored and made specifically for you based on the unique measurements and body shape information you provide. This process involves design, pattern drafting, cutting, and sewing by our expert tailors.
 

5.2. Production Time: Please refer to our Shipping Policy for current production and delivery timelines. These are estimates and may vary due to factors beyond our control (e.g., fabric availability, unforeseen production delays). We will endeavour to inform you of any significant delays.
 

5.3. Minor Variations: Due to the custom-made nature of our garments and the inherent characteristics of luxury fabrics (such as silk chiffon, silk crepe, silk velvet), slight variations may occur between the final garment and product images (e.g., slight colour variations due to screen display, subtle differences in drape, or fabric dye lots). These are not considered faults.

6. Shipping & Delivery

6.1. Shipping Policy: Our Shipping & Delivery Policy, available on the Website, forms part of these Terms. Please review it for detailed information on shipping rates, estimated delivery times, and international shipping specifics.

 

6.2. Delivery Address: It is your responsibility to provide an accurate and complete delivery address. We cannot be held responsible for non-delivery or delays resulting from incorrect address information provided by you.

 

6.3. Risk of Loss: The risk of loss or damage to the garment passes to you upon successful delivery of the garment to the address you specified.

 

6.4. International Deliveries (including Military Addresses): We ship globally, including to BFPO/APO/FPO addresses. While we dispatch within our standard production timeframe, actual delivery to international and military addresses may be subject to additional delays due to customs processing, security checks, and local postal services, which are outside our control.

7. Cancellations, Returns & Refunds Policy

7.1. Returns Policy: Our Returns & Cancellations Policy, available on the Website, forms part of these Terms. Please review it carefully.

7.2. Custom Tailored Orders - No Right of Return for Change of Mind: As each Vera Voile garment is a Custom Tailored item made specifically to your unique measurements and body shape information, it falls under the exceptions to standard distance selling regulations (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). Therefore, we are unable to accept returns or offer refunds for Custom Tailored Garments due to a change of mind or if incorrect measurements or body shape information were initially provided by the Client. These items cannot be resold.

7.3. Faulty or Significantly Different Garments: In the unlikely event that your Custom Tailored Garment arrives with a manufacturing fault, or if it differs significantly from the agreed design specifications, you must contact us immediately.

* Notification: You must notify our team via email at [Insert Email] within 48 hours of receiving your delivery, providing clear photographs of the alleged fault or discrepancy.

* Our Remedy: If, after our assessment, we determine the fault or significant discrepancy is attributable to Vera Voile, we will arrange for the item to be returned to us for repair, alteration, or replacement at no extra cost to you.

* Fair Use: This policy does not cover damage caused by misuse, accident, neglect, improper care, or normal wear and tear.

7.4. Cancellations by Client: Due to the immediate start of the custom tailoring process upon order confirmation, cancellation requests must be submitted within 24 hours of placing your order. Requests made after this period may be subject to a non-refundable charge for materials and work already undertaken.

7.5. Cancellations by Vera Voile: We reserve the right to cancel an order if:

* We have insufficient stock to produce the item.

* We cannot obtain payment.

* A pricing or product description error has occurred.

* We are unable to fulfil the order based on the information provided (e.g., measurements fall outside our workable range, or the photo is insufficient). In such cases, a full refund will be issued.

8. Intellectual Property

8.1. All Content on the Website, including but not limited to designs, images, text, logos, and software, is the property of Vera Voile or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2. You may not reproduce, distribute, modify, create derivative works from, publicly display, or in any way exploit any of the Content without our prior written permission.

9. Privacy Policy

Your privacy is very important to us. Our Privacy Policy, available on the Website, sets out how we collect, use, store, and protect your personal information, including your measurements and body shape photographs. By using our Website and services, you consent to such processing and you warrant that all data provided by you is accurate.

10. Limitation of Liability

10.1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

10.2. Subject to Clause 10.1, Vera Voile will not be liable for any indirect or consequential loss or damage arising under these Terms or in connection with the Website or our services.

10.3. Our total liability to you in respect of any losses arising under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of the Custom Tailored Garment(s) you purchased.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vera Voile, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms or your use of the Website.

12. Dispute Resolution & Governing Law

12.1. We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with the services, please contact us as soon as possible.

12.2. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

12.3. You and Vera Voile both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

13. General Provisions

13.1. Entire Agreement: These Terms, together with our Privacy Policy, Returns & Cancellations Policy, and Shipping Policy, constitute the entire agreement between you and Vera Voile in relation to your use of the Website and services.

 

13.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

No Waiver: No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Vera Voile to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
